Representations and Warranties

Indemnity

You will indemnify and hold harmless Root Cause Consultation, Rachel Larcom, and all affiliates, partners, directors, employees, agents, and representatives from any loss, liability, claim, demand, fees, and expenses, including reasonable attorney’s fees made by any third party (which means anyone other than you) due to or arising out of your Use of the Root Cause Consultation Site, including, without limitation, any Claim arising from your providing any third party with any Supplements or other products that you have bought through the Root Cause Consultation Site.

Shipping

Supplement orders are subject to any and all shipping and handling cost listed by that company

Additional Gift Card Terms

Root Cause Consultation reserves the right to reverse any Gift Card purchase for any reason and return the funds to the purchaser’s Root Cause Consultation account.
Root Cause Consultation Gift Cards may not be purchased for sellers in lieu of payment for Root Cause Consultation items.
Root Cause Consultation Gift Card resale is prohibited.
Root Cause Consultation Gift Cards cannot be redeemed for cash and have no cash value.
Root Cause Consultation Gift Cards cannot be used to purchase other Root Cause Consultation Gift Cards.
Neither Root Cause Consultation nor Root Cause Consultation’s retailers are responsible for lost, stolen, or misused Gift Cards or Gift Card codes.
Root Cause Consultation Gift Cards may be purchased or redeemed by residents of the United States only.

Protecting Your Packages

Root Cause Consultation is not responsible or liable for lost or stolen packages. We will not replace packages or send refunds for packages that have been marked delivered by our delivery carriers. You are responsible for keeping your own packages safe.

Your Responsibility to Protect Your Account

Root Cause Consultation reserves the right to withdraw or amend this Site, and any service or material we provide on the Site, in its sole discretion without notice. Root Cause Consultation will not be liable if, for any reason, all or any part of the Site is unavailable at any time or for any period. From time to time, Root Cause Consultation may restrict access to some parts of the Site, or the entire Site, to users, including registered users.

Testing Products

TESTING PRODUCTS NOTICE:
Please note, notwithstanding the foregoing, Root Cause Consultation Tests are not currently available in the States of New York, New Jersey, or Rhode Island. In addition, such tests are available only to individuals who are over 18 years of age.

Root Cause Consultation is NOT your healthcare provider.
The information provided by Root Cause Consultation is for purposes of improving your wellness only and is not intended to provide medical advice, diagnosis, or treatment. We engage the services of a licensed physician or other person authorized by law to order the blood test and to receive your results prior to making your reports available to you. However, these interactions are not intended to create, nor do they create, any doctor-patient relationship. The Content and Services (including any reports we provide you) are for informational purposes only. The Services are designed to help support the health-related choices that you make. These choices are yours and may require the advice of a healthcare provider. The Content is not intended to be a substitute for professional medical advice, diagnosis, or treatment, or recommendation regarding medication. Information, views, and opinions expressed in Public Forums are the views of the person posting the message, do not necessarily reflect the views of Root Cause Consultation, and are not endorsed, supported, encouraged, sanctioned, verified, or agreed upon by Root Cause Consultation, including, but not limited to any so-called “expert,” “moderator,” “blog-editor,” or other individual functioning in a similar capacity. Root Cause Consultation reserves the right to remove or edit your User Content and any other Content that we believe may be offensive to our audience and/or which violates our family-oriented standards. WITHOUT LIMITATION OF THE FOREGOING, ROOT CAUSE CONSULTATION DOES NOT ASSUME RESPONSIBILITY OR LIABILITY FOR THE CONTENT FOUND IN ANY PUBLIC FORUM, NOR FOR ANY CLAIMS, DAMAGES, OR LOSSES RESULTING FROM ANY USE OF ANY PUBLIC FORUM, NOR FOR ANY ACTION TAKEN BY ROOT CAUSE CONSULTATION AS A RESULT OF SUCH USER CONTENT OR COMMUNICATIONS.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Root Cause Consultation LLC, its affiliates, suppliers, or any of their respective directors, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Site; (ii) any products purchased or obtained through the Site; (iii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iv) any interruption or cessation of transmission to or from the Site; (v) any bugs, viruses, or the like that may be transmitted to or through the Site by any third party; or (vi) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Site, whether based on warranty, contract, tort, or any other legal theory, and whether or not we have been informed of the possibility of such damage.

Warranties

Root Cause Consultation cannot and does not warrant against human and machine errors, omissions, delays, interruptions, or losses, including loss of data. Root Cause Consultation cannot and does not guarantee or warrant that files available for downloading from these sites and/or the site will be free of infection by viruses, worms, Trojan horses, or other codes that manifest contaminating or destructive properties.

Root Cause Consultation does not warrant or guarantee that the functions or services performed on the sites will be uninterrupted or error-free, or that defects in the sites will be corrected.

Root Cause Consultation may disable all or any social media features and any links at any time without notice in our discretion.

Root Cause Consultation’s entire liability and your exclusive remedy with respect to any dispute with Root Cause Consultation is to discontinue your use of the site. Root Cause Consultation and its vendors shall not be liable for any indirect, special, incidental, consequential, or exemplary damages arising from your use of the sites or for any other claim related in any way to your use of the sites, even if Root Cause Consultation had been advised of the possibility thereof.

Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states, Root Cause Consultation’s and its vendors’ liability shall be limited to the extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold Root Cause Consultation, its officers, directors, employees, agents, licensors, and suppliers harmless from and against any claims, actions, or demands, liabilities, and settlements, including without limitation, reasonable legal and accounting fees, resulting from or alleged to result from your violation of these terms and conditions or your use of the sites and/or the content.

Resolving Disputes — Arbitration

Most customer concerns can be resolved quickly and to the customer’s satisfaction by direct communication. If Root Cause Consultation is unable to resolve a complaint you may have to your satisfaction (or if Root Cause Consultation has not been able to resolve a dispute it has with you after attempting to do so informally), we each agree to resolve those disputes through binding arbitration or small claims court instead of in courts of general jurisdiction.

All disputes or claims that arise under or are related to these terms and conditions will be resolved either in small claims court or by individual arbitration in accordance with the rules of the American Arbitration Association (AAA). Unless you and Root Cause Consultation agree otherwise, any arbitration hearings will take place in the county (or parish) of your billing address. The AAA Rules are available online at adr.org, or by calling the AAA at 1-800-778-7879. Root Cause Consultation agrees to pay a consumer’s filing fee for the arbitration.

You agree to arbitration on an individual basis. Neither customer nor Root Cause Consultation shall be entitled to join or consolidate claims by or against other customers, or arbitrate or otherwise participate in any claim as a class representative, class member, or in a private attorney general capacity.

Waiver and Severability

No waiver by Root Cause Consultation of any of the terms and conditions set forth in these terms and conditions shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. If any provision of these terms and conditions is held by a court or tribunal to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent so that the remaining provisions of the terms and conditions will continue in full force and effect.
